Man mentally ill, defense says in punishment phase of murder trial

Robert Sparks never claimed to be legally insane when he killed his wife and two stepsons last year. But Mr. Sparks has been suffering from mental illness for years, his defense attorney, Paul Johnson, said Tuesday during the punishment phase of his client's capital murder trial.
Mr. Johnson spent part of Tuesday questioning Mr. Sparks' mother, aunt and sister about a family history of mental illness. All three testified that they had been concerned that Mr. Sparks, 34, needed medical help.
In September 2007, Mr. Sparks fatally stabbed his wife, Chare Agnew, and his stepsons, Harold Sublet, 9, and Raeqwon Agnew, 10. Then, Mr. Sparks told officials, he raped his stepdaughters, who were 12 and 14 at the time.
After his arrest, Mr. Sparks told police and news reporters that he committed the crimes because Ms. Agnew was poisoning him and the boys were helping her.
Viola Sparks, Mr. Sparks' mother, said that after he was released from prison for a robbery conviction, he became paranoid. He thought he was being followed and people were trying to find and hurt him, she said. He nailed the attic door shut at his mother's house and later nailed the windows shut at the home he shared with Ms. Agnew.
After Mr. Sparks told his mother that he believed that Ms. Agnew had been poisoning him, he also said his mother was poisoning him, too, Mrs. Sparks testified.
"He has to be crazy, because he should know I wouldn't do that," Mrs. Sparks said.
Mary Gill, Mr. Sparks' aunt, cares for six family members in Galveston who she said all suffer from mental illness ranging from paranoid schizophrenia to post-traumatic stress syndrome. Ms. Gill, who is a certified nursing assistant, said her nephew's behavior worried her.
Clinical psychologist Michael Chafetz testified for the defense that Mr. Sparks suffers from the psychotic disorder of paranoid delusion and anti-social personality disorder.
